Description:
The State of Colorado is fortunate to contain an abundance of natural resources. As a result, Colorado real estate brokers inevitably encounter natural resources when assisting in the buying and selling of Colorado real estate. Familiarize yourself with general natural resources concepts and their effect on the typical Colorado real estate transaction to enhance your quality of service provided to your clients. Basic concepts covered include:

  1. Oil and Gas. Learn key oil and gas terms and concepts and the key distinction between leasing and conveying oil and gas rights, as well as how an oil and gas lease works. Review different transfers of mineral rights and related consequences. Discuss pre-contract and closing oil and gas considerations.
  2. Hard Rock Minerals. Discuss differences between oil and gas leases and hard rock mineral leases. Review the General Mining Act of 1872 to understand claims, patents, and extra lateral rights. Examine the ‘right of proprietor’ title insurance exception, its origins, consequences, and solutions.
  3. Wind and Solar. Review basic concepts of a wind energy agreement, applicable Colorado law, and potential to reserve wind energy agreement proceeds. Distinguish between leasing and owning solar panels and discuss common solar panel issues that arise during a real estate transaction.
  4. Water. Understand ownership of Colorado water and review the different kinds of water rights. Discuss water courts, the prior appropriation doctrine, and beneficial use. Review how water rights are modified and transferred.
