Class Description:
The class is entitled the “Case for Water Rights Diligence” and will cover the basics of Colorado water law with an emphasis on the importance of performing water rights diligence when water rights are included as part of a real estate transaction. The core of the presentation is a series of real-world examples of the kinds of issues that can be discovered during diligence as well as the problems that can arise when water rights diligence is not performed. Bill will also describe how water rights can be addressed during the diligence period of a transaction to get that transaction to closing. Overall, students will leave class with the ability to identify possible water rights issues better and to understand when it may be prudent to call a water attorney for a diligence assessment.



Instructor: Bill Wombacher
focuses on helping clients with complex water rights issues throughout Colorado, including obtaining new water rights and protecting existing rights, water rights litigation, well permitting, and water planning. Bill routinely assists clients with real estate transactions that involve water rights issues. This includes due diligence for water rights and easements, chain of title research to confirm water rights ownership, and the drafting of deeds, leases, and agreements.
